Terms of Service

These Terms of Service ("Terms") govern your use of the KIWIClap mobile app and related services (the "Platform"), operated by Mindiv Solutions ("KIWIClap", "we", "us"). By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. What KIWIClap Is

KIWIClap is a platform that connects people who need a task done ("Posters") with people willing to complete tasks for payment ("Taskers"). We provide the app that lets a Poster describe a task, lets Taskers apply for it, and lets a Poster choose a Tasker to do it.

KIWIClap is not a party to any agreement, arrangement, or task carried out between a Poster and a Tasker. We do not employ, engage, supervise, or control Taskers, and we do not perform, inspect, or guarantee any task. Every task is a private arrangement between the Poster and the Tasker who agree to it — KIWIClap is simply the place where they meet.

2. Accounts and Eligibility

You must be at least 18 years old to use KIWIClap. You must provide accurate information when creating your account and keep it up to date. You're responsible for all activity on your account and for keeping your device and account secure.

3. No Background Checks — Please Understand the Risk

Signing up to KIWIClap only requires verifying a valid mobile phone number by SMS code. That is the only check we carry out. We do not verify anyone's identity documents, qualifications, licenses, insurance, police/criminal history, or trade skills, and we do not run background checks on any Poster or Tasker.

This means you are dealing with another member of the public whose identity, skills, and background have not been checked by KIWIClap beyond a working phone number. Both Posters and Taskers are responsible for deciding who they choose to work with, and should exercise the same care and judgement they would with anyone else they meet through a classifieds listing or a stranger online — for example, checking reviews on the app, communicating clearly before agreeing to a task, meeting in a safe or public location where practical, and trusting your own judgement if something feels wrong. KIWIClap accepts no responsibility for who a Poster or Tasker turns out to be, or for anything they do or fail to do.

4. Posting and Completing Tasks

Posters describe the task, set the price, and choose which Tasker (if any) to select from those who apply. Once a Poster selects a Tasker, it's up to the two of them to agree on the details, carry out the task, and confirm when it's done. Either party can request to cancel a confirmed task; KIWIClap's role there is limited to reflecting that request in the app, not to deciding who's right.

5. Your Content

You keep ownership of any photos, descriptions, messages, and other content you upload or write on KIWIClap. By posting content, you give us permission to display it within the app to the people it's meant for — for example, showing your job photos to taskers who might apply, or your profile photo to posters reviewing applicants. You're responsible for making sure anything you post is accurate, is yours to share, and doesn't infringe anyone else's rights.

6. Payments

Posters and Taskers arrange and settle payment for a task directly between themselves, by whatever method they agree on. KIWIClap does not process, hold, or guarantee any payment, does not act as an escrow or payment service, and is not a party to the financial arrangement between a Poster and a Tasker. Any dispute about payment — non-payment, underpayment, refunds, or the price of a task — is solely between the Poster and Tasker to resolve.

7. Tax

Any income a Tasker earns, or any GST obligations either party may have in connection with a task, is that party's own responsibility. KIWIClap has no role in and no responsibility for either party's tax affairs.

8. Health and Safety

Tasks may involve physical work, travel, tools, equipment, or visiting someone else's property. Each Poster and Tasker is solely responsible for their own health and safety, and for the health and safety of anyone else affected by a task they post or perform, including assessing whether a task or a person is safe to proceed with. KIWIClap has no visibility into and no responsibility for what actually happens during a task, and is not liable for any injury, illness, death, loss, or damage arising from or connected to a task, however it's caused.

9. Prohibited Conduct

You must not use KIWIClap to post or request anything illegal, unsafe, or fraudulent; to harass, threaten, or discriminate against another user; to post content that's offensive, obscene, or defamatory; or to try to access another user's account or interfere with how the Platform runs. We can remove content, and suspend or close an account, for breaching this section.

If you see content or behaviour that concerns you, you can report it directly from the app — from a job, a user's profile, a chat message, or a review. We review reports and may remove content, or suspend or close an account, as a result. You can also block another user from their profile at any time; this stops you and that user from messaging each other or applying to or selecting each other for a job going forward. Blocking someone doesn't undo anything from before the block, and reporting is still the right way to flag something that breaches these Terms.

10. Disputes Between Users

Any disagreement, dispute, or claim between a Poster and a Tasker — about the quality of work, payment, conduct, damage, or anything else related to a task — is between them to sort out. KIWIClap is not a mediator or arbitrator, has no obligation to get involved, investigate, or resolve a dispute between users, and is not responsible for the outcome of one. We may, at our discretion, provide reasonable assistance (such as sharing information already available in the app), but doing so does not make us a party to the dispute.

11. Resolving Disputes Outside KIWIClap

Because we don't mediate disputes between users, if you and the other party can't resolve something yourselves, you're free to pursue it the same way you would with any other person you'd dealt with directly — for example, through New Zealand's Disputes Tribunal for smaller claims, or by seeking your own legal advice.

12. Reviews

After a task is completed, users may be able to leave a rating or review. Reviews reflect the opinion of the person who wrote them, not KIWIClap. We don't verify the accuracy of reviews and aren't responsible for their content.

13. KIWIClap's Role and Limitation of Liability

To the maximum extent permitted by law: KIWIClap provides the Platform "as is", is not responsible for the conduct, acts, or omissions of any Poster or Tasker (whether online or in person), and is not liable for any loss, damage, cost, injury, or claim arising from or connected to a task, a payment between users, a dispute between users, or anyone's use of the Platform. If, despite the above, KIWIClap is found liable for anything relating to your use of the Platform, that liability is capped at NZD $100 in total. Nothing in this section limits any right you have under New Zealand law that cannot legally be excluded.

14. Suspending or Closing Accounts

We can suspend or close an account that breaches these Terms (including the Prohibited Conduct section above), misuses the Platform, or where we reasonably believe it's necessary to protect other users or KIWIClap. You can stop using the Platform and close your account at any time.

15. Changes to These Terms

We may update these Terms from time to time — for example, as KIWIClap adds features or as we improve how the Platform works. If we make a material change, you'll be asked to review and accept the updated Terms the next time you open the app before you can continue using it.

16. Governing Law

These Terms are governed by the laws of New Zealand, and any dispute relating to them is subject to the exclusive jurisdiction of the New Zealand courts.
